These Terms of Service ("Terms") govern your use of the LeadKeep website and the AI receptionist services we provide. By accessing our website, submitting a form, or engaging our services, you agree to these Terms.
1. Our Services
LeadKeep provides AI-powered receptionist and lead capture services for small businesses, including configuration, deployment, and ongoing support of AI voice agents, appointment booking flows, and related automations. The specific scope, pricing, and implementation details of each engagement are set out in the service agreement or order form signed between LeadKeep and the client.
2. Eligibility
You must be at least 18 years old and authorized to enter into a binding agreement on behalf of your business to use our services.
3. Client Responsibilities
- Provide accurate, current business information during onboarding and throughout the engagement.
- Use the services only in compliance with all applicable laws, including telecommunications, privacy, and consumer protection laws.
- Obtain any necessary consent from your own callers before recording, storing, or processing their information.
- Keep login credentials for any connected third-party systems (calendars, CRMs, payment providers) secure and up to date.
- Promptly notify us of any issue that could affect service quality or compliance.
4. Acceptable Use
You agree not to use our services to:
- Send unsolicited marketing messages that violate SMS, email, or telemarketing laws.
- Impersonate another business or person.
- Interfere with, reverse engineer, or attempt to bypass any security controls.
- Transmit harmful code or attempt to disrupt the service for other users.
5. Fees and Payment
Monthly service fees, setup fees, and any usage-based charges are specified in your service agreement. Fees are billed in advance and are non-refundable except as expressly stated in your agreement. Failure to pay may result in suspension or termination of service after reasonable notice.
6. Term and Termination
Engagements continue on a month-to-month basis unless otherwise agreed. Either party may terminate for convenience with written notice as specified in the service agreement. LeadKeep may suspend or terminate service immediately for material breach, non-payment, or misuse that creates legal or reputational risk.
7. Intellectual Property
LeadKeep retains all rights to its software, prompts, workflows, templates, and supporting materials. Clients retain ownership of their own business data, call recordings, and caller information. Clients grant LeadKeep a limited license to use this content only as needed to deliver the services.
8. Disclaimers
The services are provided on an "as is" and "as available" basis. LeadKeep does not guarantee that the AI receptionist will answer every call without error, book every appointment perfectly, or result in any specific revenue outcome. You remain responsible for reviewing AI outputs that materially affect your business.
9. Limitation of Liability
To the maximum extent permitted by law, LeadKeep's total liability for any claim arising out of or related to the services will not exceed the fees paid by the client to LeadKeep in the three (3) months preceding the event giving rise to the claim. LeadKeep is not liable for indirect, incidental, consequential, or lost-profit damages.
10. Indemnification
You agree to indemnify and hold LeadKeep harmless from claims arising out of your misuse of the services, your violation of these Terms, or your violation of applicable law, including laws governing SMS, email, and call recording.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-product notice. Continued use of the services after the effective date constitutes acceptance of the updated Terms.
